The dealer and the gas leak

When I had my Savage tuned up a couple of weeks ago
(see the posting "Impressions on First Tune Up", I
asked him to check the petcock because I smelled
gasoline when I stopped. I had also inspected that
area myself and couldn't find anything. He changed
me an extra $37.50 for that information.

The dealer told me the petcock was OK and a rubber seal
had probably become brittle with little use, but now
that I was riding it, it would be fine.

Yesterday on the way home from work, the leak got
worse -- there was actually liquid gasoline on the
hose leading from the petcock to the carb. When I
got home I loosened the clamp, cut the end 1/2
inch off the hose and reinstalled it. Presto chango!
No more gas smell. If I'd known the source, I would
have done this earlier.

Does this dealer owe me my $37.50 back? (I know, the
petcock is fine but the hose coming out of it leaks.
Wouldn't that be part of the inspection?)

Maybe this will make my mileage better -- I've been
getting mid to low 40s consistently and I hear these
bikes can do better.
